If a domain name is registered before the date of the establishment of the complainant”s trade

November 4th, 2008

If a domain name is registered before the date of the establishment of the complainant”s trade mark rights, that fact will usually defeat the complaint on the basis that the registration could not have been in bad faith. There are however limited exceptions to this rule. For example, if a third party registration of a domain name consisting of elements of two different companies” names is prompted by rumours of a corporate merger, that may be enough to constitute bad faith, notwithstanding that there may be no registered or unregistered rights in the new name.

Hamilton’s second time lucky?

“I’m human. There’s nerves. Nerves of excitement and it’s never nerves of thinking you might fail. It’s just the adrenaline pumping and wondering whether you’ll get the start perfect, what’s going to happen in the first corner because it’s unknown. You have absolutely no clue about what’s going to happen – do you go left, do you go right, do you brake early, do you brake late, will you get hit from behind, will you get a flat tyre?”

Massa ready to crown maturity

In all the chauvinistic excitement surrounding Lewis Hamilton’s fight for the world championship it is easy to overlook the fact that Felipe Massa would be an equally worthy champion. Indeed, without the engine failure that cost him the Hungarian Grand Prix, or the pit-stop shambles that did likewise in Singapore, the Sao Paolo 27-year-old could already have clinched the title.

Hard though it is to grasp, it seems that the players and administrators of English cricket didn’t realise until too late the truth that has run through every ghastly moment of their misadventure in the Caribbean.

Hamilton: ‘The main thing is that I have a fantastic family behind me’

“You know, if Lewis makes it to Formula One next year,” Anthony Hamilton said quietly in the GP2 paddock at the Hungaroring in 2006, “I don’t suppose I will go to more than three or four grands prix a year. I would feel like I was in the way, some sort of intruder who didn’t belong…”

Radcliffe the Big Apple’s ‘marathon mom’

October 27th, 2008

In our time, American free speech law has become an issue of international appeal since the Internet rose as another main medium of communication. Probably, this is because many banned groups can take advantage of Internet service providers based in the United States to send their messages around the world, even where such speech is banned. U.S. courts will not enforce foreign judgments contrary to domestic public policy, including the liberal U.S. policy on free speech. As for the U.S. perspective, many Americans dislike attempts by common law jurisdictions to extend their personal jurisdiction to American defendants whose alleged defamatory speech acts occurred over the Internet and were not targeted towards those jurisdictions. If the First Amendment cannot protect them, what else can? Is diplomacy a solution? The fact remains that political and social scientists seem to have set off in unknown waters.

Corporate Account – When you have a corporate account the money belongs to the corporation not you

October 26th, 2008

Corporate Account When you have a corporate account the money belongs to the corporation not you personally. When the corporation is an anonymous bearer share Panama corporation your anonymity is further protected since establishing ownership of the corporation is about impossible so you would have to see who is recorded at the bank as the beneficial owner of the bank account and this requires you to convince a court in Panama to open up the bank records (something that is very rarely done) to reveal who the beneficial owner is. Even in the unlikely event a court did this this it would be of little value since the money still belongs to the corporation. So if you had a financial enemy pursuing you personally they would not be able to transfer a personal debt to the corporation very easily. They would need to show that you transferred funds to the corporation to make sure debtors could not recover the funds; it is called a fraudulent conveyance. The court cases pertaining to this are far from simple, they are expensive and time consuming and can take years to get heard in court. When wires are sent to an anonymous bearer share Panama Corporation no one knows who the owners of the corporation are, thus they do not know what natural persons are actually receiving the funds. When wiring funds into your Panama corporate bank account it is not revealing in terms of what the wire is for versus wiring money into a personal account. The Anonymous Panama Corporation adds in a nice thick layer of privacy protection.

- Another type of tennis court that you may run into is one that is made of clay

October 22nd, 2008

- Another type of tennis court that you may run into is one that is made of clay. Clay courts are made of crushed-up bricks and covered with a layer of rough, loose clay. Clay courts make the ball stick to the ground more, causing the ball to slow down. Consequently, you may find yourself skidding when performing quick movements due to the loose surface. To win on a clay court, work on hitting the ball deep into your opponent”s side of the court, putting as much spin on the ball as you can. This limits your opponent”s opportunities to return the shot. Also, you may want to consider making shots that will put your opponent off of their footing, causing them to miss the return.

Life at Tottenham Hotspur is similar to the economy right now. Two periods of negative growth – the end of last season after winning the Carling Cup and the start of this campaign – and they are indeed in recession.
